Data processing for scientific or historical research and statistical purposes

(Corresponding to §27 BDSG).

Art. 30 of Law 4624/2019 allows data processing without the consent of the data subject for scientific or historical research and statistical purposes. The data controller must take appropriate and specific measures to safeguard the interests of the data subject. The rights of data subjects (Articles 15, 16, 18, 21 GDPR) are restricted to the extent necessary to fulfill the investigation for statistical purposes. If possible, certain categories of personal data should be anonymized.

The data protection officer may only publish personal data if the data subject has given his/her consent or if this is indispensable for the presentation of research results on current events.

In such circumstances, there are some restrictions on the exercise of data subjects’ rights, such as the right of access or the data subject’s right to rectification or the rights under Art. 18 (1) (a), (b), 20 or 21 GDPR.
