Tasks and powers of the Slovak supervisory authority

The Slovak Data Protection Authority is responsible for the control of the lawfulness of personal data processing and compliance with data protection legislation. It may carry out data protection proceedings, that are either based on the data subject’s initiative or not. The template for initiation of such proceedings (in Slovak) is available here.

The purpose of such proceedings is to determine, whether the processing violated rights of natural persons or any data protection legislation. In case the Slovak Data Protection Authority identified such violations, it may impose sanctions or measures to remedy the situation

The Slovak Data Protection Authority shall decide within 90 days after the beginning of the proceedings. However, under specific circumstances, the time period may be prolonged. In the decision, the Slovak Data Protection Authority may for example:

  • Impose measures to remedy the situation and set a time period
  • Annul the code of conduct or a certificate
  • Impose a sanction

The company may challenge the decision via administrative court proceedings.

Either during the data protection proceedings or without any relation to such proceedings, the Slovak Data Protection Authority may carry out inspections.
