Proceedings

Proceedings before the Chairman of the Data Protection Office are considered one-instance (level) administrative proceedings. An appeal against the decision must be submitted to the administrative court (Art. 7 Data Protection Act). The SA may order the restriction of processing during the proceedings, when it foresees serious consequences, resulting from the continuation of the processing (Art. 70 Data Protection Act). Further, the Chairman may submit a preliminary question to the Administrative court, if he/she finds reasonable doubts during the proceedings as to the Commission’s decisions on the codes of conduct, adequacy decisions and standard contractual clauses (Art. 71 Data Protection Act).

Inspections

The SA may carry out inspections in order to check the compliance with data-protection laws. Such inspections take place from 6 a.m. to 10 p.m. and may cover the inspections of the documents, premises, objects, devices, carriers and IT systems used to process personal data (Art. 84 Data Protection Act). The SA may be assisted by relevant specialists (Art. 82 Data Protection Act) or police (Art. 85 Data Protection Act).
